"Marshal Roberts Tells Officers Of Firing Shot Which Resulted In Death Of Harrison Luster, Panther

"Marshal Roberts, 74, mountaineer of the Panther creek section, is a prisoner in the McDowell
county jail, Welch, following his surrender Tuesday after a hike of more than 30 miles through the mountains. Roberts told officers he shot Harrison Luster to death last Sunday as a result of a family
fued of long standing. Roberts, a little man with a heavy gray beard, told his story to numerous persons
and said he killed the man in order to protect his own life.
"Roberts, with his wife and step-daughter, lived about 12 miles from Panther on the head of Panther creek. He said that he had lived in McDowell county practically all his life.
"According to the man, he had trouble with Luster and some of his kin and he had wanted them to staf (sic) off his premises. On several occasions they had been to his house and every time they came, they had caused some kind of trouble. He said he was afraid of the clan of Lusters and had looked for trouble with them for sometime.
"Roberts said on Sunday afternoon Harrison Luster and his cousin, Lloyd Luster, came to his home. Both men were on horses and Harrison got off his house and started into his gate. Roberts said he warned Luster to stay away but the man, who he desribed as being much bigger and younger, did not heed the warning. He got inside the gate and then Marshall fired, After he shot he ran back into the house and loaded his gun again.
"He came back out and ordered Lloyd to leave. He said Lloyd made threatening remarks before departing.
"Roberts said he was affraid to go out to see if the man was dead but took his gun and left the home. On the road he met one of his friends who advised to give himself uo to an officer.
"He went over the mountains and came to the home of Maston Christian, near Roderfield. Here he stayed all night and the next morning he told Christian of the killing and said that he was going to give up to officers.
"Christian told him that his son was an officer and that he could give himself up and go with him to Welch. He came to Welch late Tuesday evening with Add Christian and was lodged in the county jail.
"The old man told of the hardships he endured comign (sic) through the mountains, nearly 30 miles, and how he used his shotgun for a cane. He said he had rheumatism, and walking through the mountains was difficult"
