"A posse of McDowell county authorities are combing the hills in the vicinity of Hensley today in
search of Cleave Atwell, 38, wanted for the slaying of Sherman Darby 24 and Ernest Darby, 26,
brothers, which occured early Tuesday night a short distance from the company store at Hensley.

"The posse, headed by Deputy Sheriffs Harry Franklin and HarryChafin, has been seeking the alleged slayer of the two brothers since 9 o'clock Tuesday night when Atwell fled to the mountains after shooting down the brothers. At noon today no arrests had been made.

"Sherman and Ernest Darby were killed about 8:30 Tuesday night when accompanied by the former's wife. Atwell stepped from between the gondolas and without warning opened fire on Sherman killing him instantly. Apparently thinking that Ernest Darby was Ras Collins, who had seperated him and Sherman from an argument earlier in the day, Atwell shot down Ernest and he died a few minutes after Dr. Newkirk, a company physician, reached the scene. Sherman was shot three times and Ernest twice and they fell only a short distance from each other. Mrs. Sherman Darby and her small child escaped uninjury (sic, ininjuried).

"Family Quarrel"
"The shooting was the outgrowth of a family quarrel between the Atwells and the family of Sherman Darby, which came near reaching a climax late Tuesday afternoon when Sherman and Atwell almost came to blows. All the trouble is said to have orginated between the children of the two families, while Ernest Darby is believed to have been a victim of mistaken identity when shot down by Atwell Tuesday night.

"Information recieved from Hensley this morning was to the effect taht Sherman Darby and Atwell had not been on intimate terms for about a month, when the children of the latter and the smaller ones of the former had some trouble Again Tuesday the children had a falling out and when the two men returned from workin the afternoon Atwell is said to have used a considerable amount of profane language in front of Mrs. Sherman Darby. The two families live just a few stes from each otherup the hollow from the company store and it is said that when Atwell started his abusive language toward Mrs. Darby, Sherman resented.

"At this instant Atwell is said to have gone to his home and received a pistol and coming back to the front of his home continued to curse the entire Darby family. Ras Collins, father-in-law of Sherman Darby, who lived just a short distance probably saved the men from having a fight at this time by leading Sherman into the Darby home.

"This ended the trouble and a short time later Mrs. Sherman Darby went to the company store. Sherman later visited the store for the alleged purpose of seeing one of the mine officials and getting today off so that he could come to Welch and have a peace warrant sworn out for Atwell.

"After completing his business Sherman with his wife and small child and brother started homeward. They were walking together and had just crossed the road and started up the hollow when Atwell stepped from betwen the coal cars parked on a siding. Some presume that Ernest started to step between Atwell to keep him from shooting Sherman, but the latter was shot down first. Atwell then turned the gun on Ernest and after mortally wounding him fled to the mountains. Neither of the young men were armed with guns.

"Ernest and Atwell had never had any trouble between them and they were always on good terms. No reason is assigned for the killing of Ernest, unless it was mistaken identity, thinking Ernest was Ras Collins.

"The two borthers married sisters, who were daughters of Mr. and Mrs. Ras Collins, of Hensley. Sherman is survived by his wife and three children and Ernest by his wife and two children. Their mother and father, Mr. and Mrs. George Darby live at Hampton Roads, just a short distance from Hensley.

"Funeral services will probably be held Thursday afternoon at the Holiness church, with internment in the Hensley Cemetery.

"The bodied of the victims were taken to the morgue of Hunter Bros, undertakers at Davy, to be prepared for burial.

"The three men had worked in the mine there for several years and none had ever been in any sort of trouble before the mine superintendent said. The mine will be shut down tomorrow for the funeral, it was announced. The Darby brothers grew up in the Hensley community."

"Cleveland Atwell was brought to Squire Huffor's office at 2:30 o'clock by Deputy Sheriff, Mannie Shore. He was taken directly to Judge Herndon of the circuit court who was to fix the bond to be asked. Formal hearing had not been conducted but Squire Hufford believed that $10,000 bond would be asked.

"Cleveland Atwell, wanted by county authorities on a charge of killing the two Darby brothers at Hensley Tuesday night, surrendered Wednesday at War and was to be brought to Welch this afternoon for preliminary hearing before Squire A.C. Hufford.

"Atwell explained that he wished to give up to authorities outside the Hensley community for fear the feeling against him would be strong. After the shooting, which resulted in the death of Sherman and Ernest Darby, Atwell walked to Iaeger and took a taxi to War, where he gave himself up yesterday morning.

"Atwell said that he had had another quarrel with the Darby brothers before that which brought on the shooting, and had gone to Squire Hufford for a peace warrant against them. He said that serious trouble had been developing for several days.

"Atwell' Version"

"On the night of the shooting, Atwell said, he drove his car to his garage, some distance from his home, and as he started to shut the door somebody stepped out from behind it and struck at his head with a piece of iron. Atwell thre up his arm and warded off the blow but received a wound which had to be dressed later. He said that the man struck him and grabbed him by the collar and with one arm around him continued his efforts to strike him with the iron. He said he shot the man as he still clung to him.

"Then he heard a noise behind him and another man drew his arm back to hit him, but he shot him before he could strike.

""I had very few friends at Hensley", he said "I was excited and was afraid of a mob, as the Darby boys were so much better known tan I. I hadn't lived there very long. So I went to War to give up"

"An officer at War in talking to Atwell, without recognizing him, told him about the officers looking for the man accused of murdering the Darby brothers. Knowing that Atwell was from Hensley the officer asked Atwell to give a complete description of the accused man.
